“Computer crimes” is a concept not specifically and directly defined in our laws, but can be defined in terms of examples of such crimes in law. Cybercrime refers to crimes committed in cyberspace by computer and digital tools such as computers and mobile phones. In the Computer Crimes Law adopted in 2009 and the Law on the Punishment of Persons Who Act Unauthorized in Audio-Visual Affairs, punishment has been determined for them. Therefore, the more precise term for these crimes is "cybercrime" because these crimes are committed in cyberspace by any means that can affect cyberspace, of which the computer is one. As mentioned above, two important laws are the main source of determining cybercrime; The Computer Crimes law and the Law on the Punishment of Persons Who Act Unauthorized in Audio-Visual Affairs. The examples of computer crimes should be sought in these two laws.

One of the most important and common computer crimes can be:

  1. Computer fraud;
  2. Crimes against chastity and public morality;
  3. Defamation and dissemination of lies;
  4. Unauthorized eavesdropping of non-public data transfer in computer and telecommunication systems;
  5. Computer forgery;
  6. Unauthorized access to data or computer and telecommunication systems.

Computer crimes are those in which it is very difficult to prove the occurrence of a crime and to find the accused and to attribute the criminal act to the accused. Thus, legal experts in this field are needed to deal with these crimes. Hence, in judiciary, attorneyship and in the law enforcement force, experts in this field must deal with computer crimes. Therefore, in Articles 30 and 31 of the Law on Computer Crimes, the legislature has obliged the judiciary to establish specialized branches in public, revolutionary, military and appellate courts to deal with the crimes. In this regard, for example, in Tehran, a special court for the investigation of computer crimes and communication technology has been established in the 31st district of Tehran, and in the police force, the FATA police is the "Iranian Information Production and Exchange Space Police or the Iranian Cyber ​​Police".
