"Land Use Change Crime"

According to the law on preservation of the use of agricultural lands and gardens approved in 1995, amended in 2006, if a land or a garden is located outside the boundaries of cities and villages (so-called out of context), its use cannot be changed from agricultural or garden to residential or trade.

Constructing a building, building a room, swimming pool and parking lot in lands outside the boundaries of cities and villages constitutes the actus reus of this crime.

On the other hand, Opinions are different as to the construction of sanitary facilities and rooms for storing agricultural tools.

Some consider it an instant crime that can be subject to the passage of time after three years from the date of the crime and non-prosecution, and others believe that it is continuous.
